MHA Directive on Section 479 Implementation

The Ministry of Home Affairs (MHA) has directed states and Union Territories to implement Section 479 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. This section aims to alleviate prison overcrowding by releasing undertrial prisoners who have served a significant portion of their potential maximum sentence. Eligible detainees include first-time offenders and those who have served at least one-third to half of their sentence for non-capital offenses. Prison authorities are mandated to apply to courts for bail or bond for these prisoners. This initiative aligns with broader reforms to enhance fairness and efficiency in India’s criminal justice system.
